1. Purpose
These Terms of Use and Sale (the “Terms”) govern access to and use of the EXAUTHYS marketplace (the “Site”), operated by EXAUTHYS (see Legal Notice), which connects travellers (“Clients”) with tourism providers (“Providers”) across the Guiana Shield, and facilitates the conclusion and payment of services between them.
Registration on the Site and any order constitutes unconditional acceptance of these Terms. A dated version is retained by EXAUTHYS and is enforceable against the user.
2. Registration & account
Registration is open to any adult individual with full legal capacity, or to any duly incorporated legal entity acting through an authorised representative. Users must provide accurate, complete and up-to-date information and keep their credentials confidential.
EXAUTHYS enforces multi-factor authentication (MFA) on sensitive operations (payments above EUR 100, Provider bank account changes) and may block any unusual sign-in attempt.
3. EXAUTHYS' role — technical intermediary
EXAUTHYS acts as a technical intermediary within the meaning of the French LCEN Act. EXAUTHYS does not provide tourism services itself: these are delivered directly by the Providers, who bear sole responsibility (quality, safety, local regulatory compliance, insurance).
EXAUTHYS collects Client payments on behalf of Providers and remits to Providers the amount due net of commission (see Section 5).
4. Booking, payment & cancellation
Orders become firm once confirmed by EXAUTHYS and the payment method has been successfully debited. A confirmation email recaps the service, dates, price and applicable cancellation policy (defined by the Provider).
Under article L.221-28-12° of the French Consumer Code, accommodation, transport, restaurant, leisure, sports or cultural activities supplied on a specified date or schedule are not subject to the 14-day withdrawal right. Cancellation and refund terms are those set by each Provider and accepted by the Client at booking time.
5. Commission & loyalty programme
EXAUTHYS charges a commission on the Client's payment, defaulting to 15% (adjustable per Provider). The commission is fully transparent to Providers in their dashboard.
The loyalty programme awards 10 points per EUR 1 actually spent in money. Points are valid for 3 years from issuance and convertible at a ratio of 1,000 points = EUR 10 discount. Points are personal, non-transferable and have no cash value.
6. Reviews & moderation
Only a Client who actually consumed a service may post a review. Reviews are moderated a posteriori and may be removed if defamatory, abusive, manifestly false or unlawful. EXAUTHYS does not pay for reviews nor alter their content.
7. Intellectual property
All Site elements (brand, logo, code, design, editorial text) are the exclusive property of EXAUTHYS or its partners and protected by the French Intellectual Property Code. Any unauthorised reproduction, representation or use is prohibited.
8. Liability
EXAUTHYS undertakes to provide the Site under the best possible conditions, without guaranteeing uninterrupted availability. EXAUTHYS cannot be held liable for shortcomings attributable to the Provider (cancellation, delay, quality defect, accident during an activity). Clients may complain to the Provider and, if needed, contact EXAUTHYS for mediation.
9. Suspension & termination
Users may close their account at any time from their personal area or by emailing contact@exauthys.com. EXAUTHYS may immediately suspend or terminate any account in case of breach of these Terms, in particular fraud, abusive behaviour or repeated non-compliance with commitments made to other users.
10. Personal data
Personal data processing is governed by the Privacy Policy accessible from the summary. Clients are entitled at all times to the GDPR rights of access, rectification, erasure, portability and objection.
11. Governing law & jurisdiction
These Terms are governed by French law. Any dispute relating to their formation, performance or interpretation falls within the exclusive jurisdiction of the Cayenne Judicial Court, subject to mandatory consumer-protection provisions.
Pursuant to article L.616-1 of the French Consumer Code, consumer Clients may use a consumer ombudsman free of charge to seek an amicable resolution. The ombudsman's details will be published on this page once designated.
